Charges will not be filed in connection with an alleged rape that occurred after a San Diego State University fraternity party last month, the San Diego County district attorney’s office said Monday.

Spokeswoman Linda Miller said prosecutors declined to pursue the case because there is insufficient evidence and because the victim has twice indicated she does not wish to press charges.

The alleged rape occurred March 6. The victim, a Grossmont College student, told police she met the suspect, an SDSU student, during the party at the Alpha Tau Omega fraternity on Lindo Paseo Drive. She said she accompanied him to an underground parking garage nearby, where he assaulted her.

According to Miller, the suspect admitted he and the woman had sex, but he said it was consensual.

Last month, the Alpha Tau Omega fraternity was placed on probation until the end of the school year in connection with the same party. A university investigation found that the fraternity had violated five SDSU regulations, most of which relate to alcoholic beverages.

University officials said the disciplinary action was not connected to the rape accusation.
