Nine years in state prison and a $5,000 fine was the sentence handed down Friday to a Linda Vista man convicted of firing a stray shot that killed a bystander at a Marina Village fight.

David Matthew Tucker, 23, was sentenced by San Diego Superior Court Judge David Gill in the Oct. 22 death of Charles Bryant, 31.

“He deserves to be punished for his outrageous conduct in this case,” Gill said.

Testimony at his trial indicated that Tucker became involved in a parking-lot argument with Michael Moeller, 26, a San Diego police captain’s son, and shots were fired at Moeller that missed him.

Hearing the gunfire, Bryant ducked into a parked car, but one bullet went through the car’s trunk and seats, hitting him in the back and killing him.

Tucker was convicted by a jury April 9 of voluntary manslaughter, assault with a deadly weapon and attempted manslaughter of Moeller. He was acquitted of first- and second-degree murder.
