A Poway couple was found guilty Thursday and sentenced to six months in jail for failing to file California state income tax returns, according to the state Franchise Tax Board.

Robert G. Getrost, 56, a design engineer, and his wife, Audrey, 55, a schoolteacher, were convicted in San Diego Municipal Court of failing to file 1983-84 state taxes on more than $111,000 in income.

The Getrosts, who argue that taxes are unconstitutional, were sentenced by Judge Raymond Edwards Jr. In addition to the jail term, the Getrosts were placed on three years’ probation, and ordered to file forms and pay all back taxes, plus penalties and interest estimated at nearly $10,000. Edwards also ordered the couple to pay the costs of the government’s investigation--nearly $1,000.
