The Nuclear Regulatory Commission, citing a lack of time to conduct hearings, on Thursday denied a request from the Long Island Lighting Co. to increase operating power at the Shoreham nuclear plant to 25%.

“There’s no way that our regulations and procedures will allow us to conduct such a procedure before the end of summer,” commission Chairman Lando Zech said after all five commissioners voted against the request at a hearing.

New York state officials had said they would go to court to stop the company from turning up the power at the plant, which has been licensed to test at 5% power.

The utility firm had asked permission in April to operate the plant at higher power, saying it needed the extra output during summer months.

Shoreham has been denied a full-power operating license because the state and local governments have refused to participate in emergency planning.
