If jurors in the retrial of Sagon Penn have any questions as they continue their deliberations, the answers will come from a judge new to them but familiar with the case.
San Diego Superior Court Judge Ben W. Hamrick, who presided last year in Penn’s first trial, will be filling in for Judge J. Morgan Lester, who began two weeks of military reserve duty Monday with the Army’s judge advocate general corps.
The retrial jury ended its ninth day of deliberations Monday without reaching a verdict.
Penn, 25, faces five felony counts in the shooting death more than two years ago of San Diego Police Agent Thomas Riggs and the wounding of Agent Donovan Jacobs and civilian ride-along Sarah Pina Ruiz.
The defense claims Penn, a black, fired to defend himself from a racially motivated attack.
