A question from jurors in the retrial of Sagon Penn indicated that, after 12 days of deliberations, the panel still may not be near a verdict in the case.

The jury Thursday asked San Diego County Superior Court Judge Ben W. Hamrick if it would have to work July 3--a week from today. Hamrick replied that July 3 is a court holiday, in recognition of Independence Day.

Penn, 25, faces five felony counts in the shooting death more than two years ago of San Diego Police Agent Thomas Riggs and the wounding of Agent Donovan Jacobs and civilian ride-along Sarah Pina Ruiz.

The defense claims Penn, who is black, was firing to defend himself from a racially motivated attack.
