A Border Patrol officer shot and killed a suspected illegal alien Monday about three miles north of the border in Chula Vista during a struggle for the officer’s gun, the Border Patrol reported.

Border Patrol spokesman Michael Nicley said the agent, whose name was not released, was driving alone about half a mile east of Weste Road in Chula Vista when he spotted the man, Juan Resendiz Hernandez, 42, of Mexico.

The Border Patrol agent attempted to arrest the suspected alien, but Hernandez fought back and tried to disarm the agent, Nicley said. “In the ensuing struggle, the alien was shot,” he said.

Nicley said it is believed that more than one shot was fired, but Hernandez was hit once in the chest. He was pronounced dead at the scene, 15 minutes after the 10 a.m. shooting.

The Sheriff’s Department and the Border Patrol are conducting a joint investigation of the incident, Nicley said.
