A Sierra Club challenge to the 1984 restart of the San Onofre nuclear plant was dismissed as premature by a federal appeals court. The U.S. 9th Circuit Court of Appeals said it had no jurisdiction to rule on the Sierra Club’s effort to force the Nuclear Regulatory Commission to block the restart of Unit 1 and hold public hearings on seismic safety issues. San Onofre, near Oceanside, was closed in 1982 and remained shut until 1984 after an NRC order to improve the plant’s seismic safety. The environmentalists asked the NRC to stay the restart of Unit 1 of the plant, owned by Southern California Edison and San Diego Gas & Electric Co., until public hearings were held.
