Share

By a 67-2 margin, the Assembly on Tuesday approved a measure sought by five Santa Clarita Valley school districts to establish a mechanism for them to collect a voter-approved tax on new homes.

The measure, by Sen. Ed Davis (R-Valencia), was sent back to the Senate for final passage.

The bill spells out that, until a pending court challenge of the tax is settled, builders must only pay fees in place before the June 2 election, when voters approved the new taxes to raise funds to build new schools.

Further, developers must acknowledge that, if they lose the court case, they are obligated to pay the additional taxes.

The measure also directs the courts to give top priority to t(e case and clarify that, if the schools win the case, they have legal authority to collect the tax, which is expected to range from $5,439 to $6,300 a home.
