Driver Tim Richmond and NASCAR have failed to reach an agreement that would allow the controversial driver to take part in the Daytona 500, according to Bill France Jr., president of the stock car sanctioning body.

Richmond and NASCAR are in disagreement over whether his past medical records should be examined before he be given clearance to drive. The track doctor at Daytona International Speedway, Dr. Ron Hinebaugh, wants to examine Richmond’s records to see if he is ready to drive after missing most of last year with double pneumonia.

Richmond and his attorney, Barry Slotnick of New York, maintain the records are confidential and not relevant to Richmond’s current condition. Richmond was suspended last Thursday for failing a drug test, then reinstated Monday for passing a second test.
