Malibu : Restaurant Suit Settled

The Los Angeles County Counsel’s office has recommended an out-of-court settlement of $75,000 with the owners of Alice’s Restaurant in Malibu in a dispute over parking lot privileges.

Restaurant representatives filed a $920,000 breach-of-lease suit against the county and the state for not limiting use of the adjacent parking lot to patrons of pier businesses.

The restaurant, owned by Japedemy Inc., and two other pier concessionaires in 1972 signed a 15-year lease for the property and use of the 120-space parking lot. When the state acquired the property in 1980, subject to existing leases, it requested that the Los Angeles County Department of Beaches administer the pier. The county opened the parking lots to the general public.

The restaurant owners estimated a loss of sales of up to $950,000 from July, 1980 to April, 1985.

The state has settled for $25,000 over its liability in the case.
