The district attorney’s office Friday received a report from National City police on their investigation of a weekend fight between Sagon Penn and a grocery store owner.

Detective Lt. Craig Short said the investigation found enough information to surmise that battery and an assault with a deadly weapon had occurred.

“The investigation is as complete as we can make it,” Short said. “We submitted the case and now it’s up to the district attorney whether or not to prosecute.”

District attorney’s spokeswoman Linda Miller said the report will be reviewed but said she doesn’t expect any decision before late next week.

Penn, 26, was questioned and released by police after a fight last Saturday at the Valley Produce Market on Highland Avenue.

According to police, Penn and a teen-age friend walked to the market and called the owner, Taisir Farha, to the door. The youth confronted Farha about an alleged assault earlier on the youth’s mother.

The quarreling turned into a fight between Farha and the youth. Penn intervened, police said, when Farha armed himself with a large stick. Penn reportedly grabbed the stick from the store owner and waved it about, hitting Farha’s 13-year-old son in the head.

“We got most of our information from the youth,” Short said. “Penn told us nothing.”

Penn was acquitted in the 1985 shooting death of a San Diego police officer.
