Grand Jury’s Role

In your article concerning the resignation of Phillip Schwartze from the Local Agency Formation Commission (May 19), you stated that the grand jury concluded that there was no basis to press charges against Schwartze. This information was no doubt taken from your article of March 5. Unfortunately, that information was incorrect and the grand jury was in error not to have corrected it at that time. For the record, it had been said that the administration committee of the grand jury was still looking into the matter and that a decision had not been made concerning the conflict-of-interest charges against Schwartze.

Since that time, the grand jury voted to send a formal application concerning this matter to the California Fair Political Practices Commission in Sacramento.

The California Fair Political Practices Commission has informed the Orange County Grand Jury that it is in the process of reviewing the matter to see if an investigation is warranted. With Schwartze’s resignation in the offing, their review may be a moot point.
