Local News in Brief : Newport Beach : Man Suing Police Held on Texas Parole Charge

A man who is suing the city’s police because an officer shot him in January was arrested in his attorney’s office Monday on suspicion of violating parole in Texas, police said.

Ricky Patrick Miller, 26, was arrested after a parole board in Austin issued a warrant alleging that he violated his parole on an auto theft conviction, Armstrong said.

Miller was shot in the back Jan. 23 after police stopped the car in which Miller was riding because the headlights were out.

Police said Miller ran down an alley and was chased by an officer, who drew his gun when he saw Miller crouch down between two houses.

Miller again bolted, and when the officer grabbed Miller from behind, Miller spun around, striking the officer’s revolver with his arm and causing it to fire, police said.

Miller subsequently filed a lawsuit in federal court against the city and the Police Department, alleging that the officers had been negligent and had violated his constitutional rights.

Police and city officials have denied the allegations, and the suit is pending.
