Car Insurance Initiatives on the November Ballot
O’Connell’s column is appealing and accurate until he says that Proposition 104 is modeled after the no-fault laws in effect in Florida and New York.
That statement is false. In New York, the insurance commissioner must approve all auto insurance rate increases.
Proposition 104, on the other hand, prohibits any public official from engaging in prior rate approval.
In fact, this 144-page document devotes its last 83 pages to numerous sections that would nullify provisions in two competing measures--Propositions 100 and 103--that require insurers to justify their rate increases in advance of taking effect.
