Charges will not be filed against a man who surrendered to police last week after he was identified as a suspect in the shooting of Cal State Long Beach football player Mark Seay, police said Friday.

The district attorney’s office decided that there was not enough evidence to prosecute Paul Lanier, 22, Detective Joe Thompson said. However, Lanier was being held in the Long Beach Jail on charges relating to other outstanding warrants.

Still accused in the case is a 17-year-old reputed gang member, whose name was not released because of his age, who was arrested on suspicion of assault with a deadly weapon a day after the shooting, which occurred during a children’s Halloween party.

Two gunmen opened fire on the party hosted by Seay’s sister Oct. 30. While shots were flying through the air, Seay grabbed a child and covered her with his body, taking a bullet in the back.

Seay, 21, was released from Memorial Medical Center after doctors removed a kidney penetrated by the shot.
