Local News in Brief : Laguna Beach : Commissioner Issues Order on Grading

Grading of a Laguna Beach knoll at the Top of the World neighborhood was halted after Orange County Superior Court Commissioner Eleanor M. Palk issued a temporary restraining order pending a hearing Friday.

At the hearing, several Laguna Beach residents will request a preliminary injunction to halt construction on the 7-acre knoll until a lawsuit, filed by resident Karen Feuer-Schwager against the California Coastal Commission and the Laguna Beach Unified School District, goes to court.

While Palk’s order only names the Coastal Commission and the school district, the owner and developer of the property, M.J. Brock & Sons Inc., voluntarily halted construction to avoid complications while the hearing is under way.

Feuer-Schwager filed the suit against the parties last November, charging that grading and construction on the knoll would cause irreparable damage to the area.

The Laguna Beach Unified School District sold its 20-acre parcel of land to the Brock company in 1987 for $3 million.
