Linebacker Lawrence Taylor of the New York Giants will be prosecuted for driving while intoxicated, a municipal prosecutor said, although his car was parked when police apprehended him a week ago and he was not legally drunk.
Taylor has undergone drug rehabilitation twice in the last three years.
Authorities allege Taylor was found sleeping at 3:30 a.m. on March 24 behind the wheel of his Jeep while parked on the shoulder of the Garden State Parkway. A breath analysis found Taylor had 0.09 percent blood alcohol. Under New Jersey law, 0.10 percent is considered legally drunk.
However, Saddle Brook (N.J.) Municipal Prosecutor Joseph Mecca Jr. said the case will be based upon observations of the officer.
Taylor has denied being drunk. He said he had been bowling until about 11:30 p.m. and then had a “couple of drinks” after a family argument. He said he got sick because he hadn’t had a drink in about five months.
“I want my fans, what’s left of them, to know that I’m OK,” Taylor said. “I didn’t do anything wrong. All I did was get sick.”
