A misdemeanor assault case in which a San Diego police officer was charged with striking a handcuffed man while arresting him at the beach ended in a mistrial Tuesday after a Municipal Court jury announced it was deadlocked, 7-5, for acquittal.

The jury, which began its deliberations Monday, was unable to reach a verdict in the case against Officer Jeffrey M. Jacob, a three-year veteran who allegedly struck Christopher Del Larsen in the face with a soda can Oct. 1 in the 3000 block of Ocean Front Walk.

The officer allegedly struck Larsen while his hands were handcuffed behind his back, then threw him to the ground.

However, Jacob has maintained that he merely touched Larsen with the can and did not use it as a weapon against the man, who was drunk at the time of the arrest.

A date for a new trial will be set May 30.
