Judges of the North Orange County Municipal Court decided after a meeting this morning to ask for the resignation of Court Commissioner Robert K. Tuller Jr. after his arrest last week on suspicion of cocaine possession.

Presiding Judge Linda Lancett Miller said she and the 11 other judges on the North Court bench in Fullerton asked that Tuller submit his resignation effective July 1. If he chooses not to resign, state law empowers the judges to fire him.

Tuller, 46, was not immediately available for comment this morning. He was freed after posting $5,000 bond after being arrested Friday in a cocaine sting operation staged at the Anaheim Sheraton Hotel by Anaheim police.

The arrest culminated a six-month investigation by Anaheim police, the district attorney’s office and state Bureau of Narcotics Enforcement. The investigation was launched after police received a tip that Tuller, a nearly four-year veteran of the North Court bench, used cocaine on a “regular basis.”

Miller said this morning that she and the other judges regretted asking Tuller to leave.

“The unfortunate incident of last Friday made this action necessary but unpleasant, given the good service he has provided to this court,” Miller said.
