Malibu : Incorporation Suit Filed

Attorneys for the would-be city of Malibu filed a lawsuit Tuesday with the state Supreme Court to force the Los Angeles County Board of Supervisors to allow the city to incorporate immediately.

The lawsuit alleges that the supervisors violated the constitutional rights of Malibu voters and the City Council-elect in delaying incorporation. Malibu residents voted overwhelmingly in June to become a city, but the board delayed official cityhood until March of next year.

“We believe the county has abused its power,” said Christi Hogin, one of the attorneys who prepared the suit. “Malibu residents voted to become a city and they elected council members who are unable to take office. We believe this refusal is a violation of the due process clause under both federal and state law.”

The county has 30 days to respond to the suit. “We are hoping the court will issue an order by mid-November to incorporate,” Hogin said.
