Prosecutors will review police reports Monday of a single-car accident that left legendary jockey Bill Shoemaker partially paralyzed, Joe Flores of the California Highway Patrol said Friday.

A blood test taken at Glendora Community Hospital 2 hours 10 minutes after the accident in San Dimas Monday night showed that Shoemaker, 59, had a blood-alcohol level of 0.13%, according to an arrest report. It is illegal to drive in California with a blood-alcohol concentration of .08% or greater.

Shoemaker faces a possible misdemeanor charge of driving under the influence.

Shoemaker, of San Marino, remains in critical condition at Centinela Hospital Medical Center in Inglewood, where he was taken Tuesday.

“The Shoemaker family would like it to be known how appreciative they are of everyone’s concern,” a hospital spokesman said in a statement. “Bill is alert and responsive, but still has a mountain to climb.”
