Amphitheatre Loudness Claims Joined Into 1 Class-Action Suit
A judge has ordered consolidation of all loudness claims against the Pacific Amphitheatre into a single class-action suit covering concerts since March, 1987.
According to Superior Court Judge James R. Ross’ ruling, the homeowners may be joined by the occupants of more than 200 homes in the Mesa del Mar tract surrounding the Orange County Fairgrounds.
In March, 1990, some homeowners filed individual damage actions against the facility’s operators in Municipal Court. The operators then filed a cross-complaint against the homeowners, moving the suit to Superior Court.
The ruling “helps us and it helps them, as well,” said Richard L. Spix, the attorney representing the homeowners.
The Pacific will now be able to deal with one large lawsuit instead of many small ones, he said.
The other homeowners have “a reasonable time” after formal notification, probably 30 to 45 days, to ask Ross to remove them from the litigation. No trial date has been scheduled.
Attorneys for the facility declined comment.
