A federal judge turned down a defense request to move the bank robbery trial of accused A’s Bandit David W. Malley to another county.

The trial for Malley, 22, of San Diego, will begin Oct. 16 in San Diego. He is charged with robbing 28 banks from Feb. 5 to April 26 of this year, many of them while wearing an Oakland A’s baseball cap.

U.S. District Judge Judith Keep on Monday denied the change of venue motion but also ruled that Malley’s attorney, David Bartick, could renew the motion if he finds during jury selection that potential jurors are aware of the bank robbery series.

Bartick presented as evidence more than 60 newspaper articles on the robbery series.

Assistant U.S. Atty. Patrick O’Toole said Malley will go on trial on eight bank robbery counts first. Malley will be tried later on the other robbery charges.

Malley remains in Metropolitan Correctional Center without bail.
