Court Challenge to Prop. 13

Share

If the U.S. Supreme Court decides to overturn Proposition 13 on the grounds that it violates the equal protection clause of the Constitution, then the solution is simple. All we need is a new proposition that rolls back the property tax on the plaintiff’s property to the 1975 level and then apply a 2% increase for each year subsequent to 1975. Other properties in the same category as the plaintiff’s property, i.e., properties that have had a change of ownership since 1975, would also have their property taxes rolled back.

If we fail to enact such a proposition, then the politicians will act like politicians always do. They will raise the property taxes on the “low tax property” up to the level of the present taxes on the “high tax property.” We must not let that happen.
