SAN DIEGO : Life Without Parole Sought in Slaying

Special circumstances were filed Friday alleging that Robert Mack was “lying in wait” before he opened fire on executives at the General Dynamics plant, killing one and severely wounding another.

Deputy Dist. Atty. Robert Sickels said his office will not seek the death penalty but will urge a sentence of life in prison without the possibility of parole if Mack is convicted.

Mack, 42, who worked for General Dynamics for 25 years before he was fired Jan. 15, pleaded not guilty to charges of murder and attempted murder in the Jan. 24 shootings at the Kearny Mesa plant.

Labor negotiator Michael Konz, 25, was shot in the back of the head and killed. Mack’s former supervisor, James English, 52, was also shot in the head but survived.

San Diego Superior Court Judge Frederic L. Link scheduled a June 24 trial. Mack remains in County Jail without bail.
