An Imperial Beach man who aimed an unloaded gun at a Port Hueneme police officer and pulled the trigger, after an altercation with a girlfriend last year, was sentenced to 10 years in state prison.
The case against Roger Fernandez Aguillon ended Monday when a Ventura judge issued the sentence.
Aguillon was convicted of assaulting a police officer with a firearm, said Deputy Dist. Atty. Bob Meyers.
The incident, which occurred in September, involved two officers and a reserve officer with the Port Hueneme force who chased Aguillon through an alley and into a carport in the 600 block of Evergreen Lane after receiving a report about a man with a gun.
Officer Kenneth Dobbe, who arrived first at the carport, saw the gun and ducked, Meyers said. When Officer James Evans and reserve Officer Martin Garcia arrived, Aguillon pulled the trigger, Meyers said. However, there was no bullet in the gun’s chamber.
Aguillon’s attorney, William Maxwell of Ventura, said he did not believe his client meant to shoot the officers. The fact that the clip was not engaged should have been considered, he said.
