The district attorney’s office has declined to file charges against two Fountain Valley police officers in connection with the fatal shooting of a 29-year-old theft suspect in March, authorities said Tuesday.

“We have concluded there is no evidence of any criminal culpability on the part of any Fountain Valley police personnel in this case,” said Deputy Dist. Atty. Christopher J. Evans, who reviewed the case.

Salvador E. Acosta of Santa Ana was shot and killed March 16 in the parking lot of a Thrifty store at Harbor Boulevard and Edinger Avenue.

Acosta ran from the store and across the parking lot about 6 p.m., clutching aspirin and some other over-the-counter medications he had stolen, according to police. He jumped into a 1987 Oldsmobile and accelerated toward two uniformed patrol officers who arrived at the scene, police said.

One officer had to jump out of the way of the oncoming car, and both officers fired several times at Acosta after repeatedly shouting at him to surrender, police said.
