GLENDALE : Man, 88, Convicted of Sexual Battery

An 88-year-old man pleaded no contest in Glendale Municipal Court to a count of misdemeanor sexual battery for fondling a 17-year-old girl’s breasts at a bus stop in Glendale, officials said.
Luis Magin Hernandez of the Los Feliz area entered his plea on Wednesday. Glendale Municipal Judge James Rogan sentenced Hernandez to one year of probation and ordered him to stay away from the victim and from the northeast corner of Los Feliz Road and Brand Boulevard, where the incident occurred Dec. 3.
Through a Spanish interpreter, the defendant apologized to the judge before sentencing, said Deputy Dist. Atty. Anne Hennigan.
“He’s kind of senile,” Hennigan said. “It was thought that jail time would not be appropriate.”
Hernandez’s defense attorney, Michael V. Severo, could not be reached for comment Wednesday.
Hernandez, a widower who lives in a retirement home, was arrested Dec. 3 after two marshal’s deputies and an off-duty Glendale police sergeant saw him confront the girl at the bus stop.
