City Appeals Decision Favoring Developer
The city of Thousand Oaks has appealed to the state Supreme Court a December appellate court decision that said the City Council unfairly denied a Newbury Park developer his rights.
The lawsuit by Albert Cohan and his family contended that city officials had unfairly stalled the developer’s plans for a 47-acre housing and commercial development in Newbury Park.
In December, the 2nd District Court of Appeal ruled that the city had not followed proper procedures in handling Cohan’s project.
City Atty. Mark Sellers said the high court will make its decision on whether to hear the appeal in 60 to 90 days.
Cohan’s attorney, Wendy Lascher, said she thinks it unlikely that the Supreme Court will hear the city’s case. “They only hear 4% to 6% of the cases they are asked to take,” Lascher said.
She said she is confident the earlier decision will stand.
