A candidate for Diamond Bar City Council is taking his campaign to the courtroom today to challenge the results of a vote recount that left him and his opponent in a dead heat.

Don Schad and his attorney, Al Perez, said they will ask a Superior Court judge to review three challenged ballots that could tip the vote count in Schad’s favor.

After Schad and his opponent, Carol Herrera, deadlocked at 1,609 votes each two weeks ago, they asked the council to include a runoff in a special election scheduled for March. Tied City Council races are generally solved by drawing lots, city officials said.

Herrera and her attorney, Fred Woocher, will be at the hearing, but Woocher said he expects “the case will be laughed out of court.”
