Judge Throws Out Election Challenge

Two months after the Diamond Bar City Council election, a judge may have finally resolved a tight race by throwing out candidate Don Schad’s legal challenge to Carol Herrera’s victory.

Herrera tied with Schad--each received 1,609 votes--but then gained victory by the drawing of lots last month. However, before the drawing, Schad challenged Diamond Bar’s counting of three ballots. Los Angeles Superior Court Judge Robert O’Brien rejected that challenge Thursday, saying Schad should have named the county registrar, not Diamond Bar, as the defendant. The candidate is considering whether to pursue the matter further, according to his wife, Lee Schad.
