Chicago White Sox outfielder Tony Phillips won’t face criminal charges for punching a heckler during a game last week in Milwaukee, the district attorney’s office said Thursday.

Instead, Phillips and the fan, Chris Hovorka, 23, of Racine, Wis., were cited for disorderly conduct and ordered to pay $287. The county charges, similar to speeding tickets, don’t carry jail time.

Outfielder David Justice, the star of the Atlanta Braves’ victory in the deciding game of last year’s World Series, will sit out the rest of this season after three hours of surgery in Atlanta to repair a damaged right shoulder.

Joe Chandler, the team orthopedist who performed the operation, expects Justice to be able to participate in spring training.

“I do not anticipate the full recovery to occur for about a year. I would expect him to come back and be the same player he was before,” Chandler said at a news conference at Piedmont Hospital.
