Executives: Lawyers representing former Walt Disney Studios Chairman Jeffrey Katzenberg are moving to force the studio to turn over documents that contain financial information that Katzenberg argues he needs to verify the accuracy of bonuses paid to him under his Disney employment contract. The move to obtain a summary judgment is the latest wrinkle in Katzenberg’s lawsuit, filed in April against Disney, in which he claims he is owed a lump sum of more than $250 million in incentive bonuses. The bonuses stem from a clause in his contract entitling him to money based on the future value of projects put into production or acquired during his 10-year tenure as studio head. Separately, court papers show Disney on Monday filed a motion asking that the issue of how much Katzenberg is owed, if anything, be arbitrated through procedures called for in his contract. In a court filing last week, Katzenberg’s lawyers filed a letter from Katzenberg to Walt Disney President Michael Ovitz dated March 29 in which Katzenberg requested the documents he wants, along with an April 4 response from Disney Senior Executive Vice President Sanford M. Litvack denying the request, calling it “nothing more than an attempt to obtain discovery outside the bounds of the governing rules.” Katzenberg left Disney in 1994 and is now a partner at the DreamWorks SKG studio.
