View Ordinance Goes Before Council Today

After years of debate and nine public hearings, the City Council today might endorse an ordinance that would define steps residents can take to resolve conflicts over views blocked by trees.

The proposed ordinance has been heavily reworked since the city’s Planning Commission began drafting it almost two years ago.

The law would require that residents feuding over blocked views first try to resolve the problem by communicating with each other. If discussions fail, the claimant would be required to take the case before a review board.

All property owners within 300 feet of the disputed tree would be notified of the hearing, which would be held regardless of whether the tree owner participates. If the tree board’s recommendation is rejected, the claimant could propose mediation or arbitration. As a last resort, the case could be taken to court.
