Temporary Ban Set on Adding News Racks
No new newspaper racks can be placed in the city for 45 days.
After a request from the owner of a real estate publication to install 25 to 50 news racks in the city, officials on Tuesday issued an immediate moratorium to allow the city attorney’s office time to study the matter.
First Amendment guarantees of a free press allow racks. Exceptions are made when placement compromises safety or the appearance of the city.
Courts generally provide greater access to traditional press, such as newspapers, but they have extended similar rights to commercial publications.
“A moratorium will allow us to study public safety and aesthetic issues,” City Atty. Alan R. Burns said.
