A Cal State Long Beach professor who has feuded for years with neighbors over conditions at her Huntington Harbour home managed to avoid temporarily a marshal’s sale of the residence, a lawyer said Wednesday. Elena Zagustin filed a motion in federal court in Santa Ana several weeks ago asking that it take over jurisdiction from the state, said attorney Tom McCurnan, who represents several of her neighbors. The filing failed but did void today’s scheduled marshal sale of Zagustin’s home.

U.S. District Judge Alicemarie Stotler rejected the motion last week, finding that the case does not qualify for federal purview. The ruling came too late to reschedule the sale, but it will be reset within 45 days.
