The 4th District Court of Appeals in Santa Ana recently ruled that the city of La Habra was not wrong to impose a utility tax about seven years ago to help pay for public safety expenses.
The Aug. 27 ruling upheld a trial court decision that found that a statute of limitations allowing any legal challenges against the 6% utility tax had expired before a 1996 lawsuit. The suit was filed by several La Habra residents and the Howard Jarvis Taxpayers Assn., and contended the City Council’s approval of an emergency utility tax in 1992 violated Proposition 62, which requires local taxes be approved by popular vote.
Attorneys for the taxpayers association said the group plans to appeal to the state Supreme Court.
