An El Toro Road spa that is suing the city over what it alleges is the unfair denial of a business license has filed a second suit over the name of the business.

The owner of Lake Forest Bodycentre charges that another local spa is violating the Bodycentre trade name by calling itself Bodycentre Day Spa.

“We are losing significant business because of the name confusion,” said Charlie Abujudeh, owner of Lake Forest Bodycentre, who filed the suit last month in Orange County Superior Court.

Both Bodycentre owners say they purchased the right to use the name through a franchise agreement with Joel Doti, who is a co-plaintiff with Abujudeh.

Bodycentre Day Spa, owned by Kelley Gast-Gutierrez, opened on Lake Center Drive in May.

Officials from the Orange County clerk’s office responsible for the filing of fictitious business names said the city is not responsible for checking to see who has a right to use a name.

A hearing over who owns the right to use the Bodycentre name is set Oct. 4 in Orange County Superior Court.
