Supreme Court’s Role
The Times opines that the next president should be committed to appointing judges who will advance civil rights, privacy and environmental protection (editorial, Sept. 24). The Constitution assigns no such role to the court. The Constitution gives the Supreme Court jurisdiction “as to Law and Fact” (Article III, Section 2). The advancement of causes is a legislative function. If The Times is not happy with this arrangement, its soapbox position should address changing the Constitution and not attempting its subversion by judicial stealth.
