L.A. Judge Dismisses House of Blues Suit

A judge dismissed a lawsuit claiming Los Angeles officials improperly tossed out House of Blues’ bid for the contract to run the city-owned Greek Theatre, representatives on both sides said.

House of Blues said the L.A. Recreation and Parks Commission erred by ignoring an analysis that found its bid superior to one submitted by rival concert promoter Nederlander Organization. The commission voted Feb. 21 to throw out both bids and start over.

Los Angeles County Superior Court Judge David Yaffe said House of Blues didn’t have enough facts to back up its claims, but gave it 21 days to refile with more information, said Adam Burke, a Nederlander attorney.

The dismissal comes two days after city officials released its list of minimum requirements for any new bids, including that the Greek’s operator must guarantee a minimum of $15 million in revenue per year, or pay penalties.
