Measure F Faces Dec. 14 Hearing

A San Diego appellate court has denied a request to reinstate passage of a March 2000 ballot measure requiring another countywide vote before Orange County could build a new airport at El Toro.
Instead, judges set a Dec. 14 hearing to consider whether to overturn a lower court judge’s decision voiding the passage of Measure F. The measure was approved by 67% of voters.
Measure F required two-thirds voter approval for new airport projects, large jails within a half-mile of homes and hazardous-waste landfills.
Los Angeles County Superior Court Judge S. James Otero ruled nearly a year ago that Measure F was unconstitutional and violated state law.
When airport foes appealed, appellate judges in Orange County recused themselves and passed the case to their colleagues in San Diego.
