A negligence and assault lawsuit filed in June against the Dodgers and Carlos Perez will include former Dodger shortstop Kevin Elster, the plaintiff’s attorney said Wednesday.

Elster is the John Doe named in Sandra Komine’s Superior Court lawsuit for injuries she says she suffered during a July 2000 airplane ride with the Dodgers, said attorney Bruce Brusavich.

Attorneys for the Dodgers and Elster could not be reached for comment.

Komine’s lawsuit also survived a legal challenge Wednesday. The Dodgers wanted the lawsuit dismissed.

Judge Emilie Elias overruled most of the challenges to the lawsuit, court documents show. She dismissed a claim of negligent infliction of emotional distress but let others alleging assault and negligence stand.

Skiing

Three weeks after the death of a teammate, Laure Pequegnot gave the French skiing team reason to cheer.

Pequegnot, overcoming a sloppy second run on which she seemed to be losing control several times, won a World Cup slalom at Copper Mountain, Colo., edging Austria’s Christine Sponring by 0.17 seconds.

The victory came 22 days after team leader Regine Cavagnoud was killed in a training accident.

Pequegnot earned her first World Cup win with a combined time of 1:37.64.

The top U.S. finisher was Kristina Koznick of Burnsville, Minn., who tied for sixth.

Miscellany

The Formula One team of Alain Prost filed for bankruptcy but still intends to race in 2002.

Prost, who dominated Formula One as a driver for much of the 1980s and early 1990s, attributed the move to poor results and a bad economic climate.

The team has not won a race since it was formed five seasons ago.

Wladimir Klitschko called off his World Boxing Organization heavyweight title defense in New York on Dec. 1 against Nigeria’s David Izon after tearing a shoulder muscle while sparring.

The 25-year-old Ukrainian will be sidelined three weeks to a month. He hurt his left shoulder in a Hamburg, Germany, gym.

Tocarra Montgomery of the United States won her first two matches by pins, putting her in good position to advance to the second round of wrestling’s world championships at Sofia, Bulgaria.

Montgomery is competing in the 1491/2-pound division of a tournament that had been scheduled for Sept. 26-29 in New York. The championships were postponed because of the terrorist attacks and shifted to Sofia.
