Telemarketers Appeal ‘Do Not Call’ List

A telemarketers group said it had appealed the Federal Communications Commission’s decision to adopt a “do not call” registry, under which 28 million Americans have signed up to avoid telephone sales pitches.

The American Teleservices Assn. filed a petition Friday with a federal appeals court in Denver, claiming that the registry violates free-speech rights. Separately, the group asked the FCC not to enforce the new rules until the court reviews them. The FCC has argued that the regulations are constitutional.

The appeal adds to a suit that the association filed in January against the Federal Trade Commission, which operates the registry with the FCC.
