From Times Staff Reports

A judge has postponed until Dec. 12 a decision on whether to retry a San Clemente man accused of negligently shooting his daughter while loading a 12-gauge shotgun in the bath- room.

A jury deadlocked 11 to 1 last month in favor of acquitting Jeffrey West, 35, of felony child endangerment in the shooting of Madison West, 9, who was seriously injured.

Superior Court Judge Patrick Donahue gave Deputy Dist. Atty. Karen Schatzle a month to respond to a motion by the defense that the case be dismissed.
