Rape Case Against 3 Teenagers Dismissed

Charges have been dismissed against three teenage boys accused of raping a 15-year-old girl in a Fairfax High School restroom.

Juvenile Court Referee Maria Escobedo granted a defense motion Wednesday to dismiss the case after the prosecution finished presenting its evidence, said Sandi Gibbons, a district attorney’s office spokeswoman.

The two 17-year-olds and a 16-year-old, all members of the school’s football team, were charged in August with one count each of forcible rape in concert.

A student at Fairfax who was taking night classes said the boys followed her into a bathroom in the late afternoon of Aug. 2 and raped her. She called police the next day.

Authorities said the boys did not have criminal records, and no alcohol or drugs were involved. Their names were not released because of their ages.

A mother of one of the boys said she was relieved by the referee’s decision.

“He always kept his head up,” she said. “We are going to try to get back on track.”

The defense attorney could not be reached for comment.
