Trio Should Pay O.C. Sex Assault Victim, Prosecutor Says

The son of a former Orange County assistant sheriff and two of the young man’s friends, convicted of sexually assaulting an intoxicated teenager, should pay her more than $66,000 for counseling, drug rehabilitation and other expenses, prosecutors argued in a court brief filed Friday.

Gregory Haidl, 20, and Kyle Nachreiner and Keith Spann, both 21, were convicted last year of assaulting the then-16-year-old girl during a July 2002 gathering at the Corona del Mar home of Haidl’s father, former Assistant Sheriff Don Haidl.

The youths videotaped their night of heavy drinking and sex.

Orange County Superior Court Judge Francisco P. Briseno will sentence the trio and rule on restitution March 10.

Haidl faces up to 18 years in prison, Spann up to 16 and Nachreiner up to 14.

The three ought to pay for counseling for the victim and her family, the family’s time off from work to attend the trial, as well as the victim’s drug rehabilitation, Assistant Dist. Atty. Chuck Middleton said.

“There was sufficient evidence during the trial to show that [the victim] spiraled downhill after this occurrence and started taking heavy drugs,” Middleton said.

“All this was as a result [of] the criminal acts by the defendants.”

The victim’s attorney, who has filed a $26-million civil suit against the three men and others, declined to comment on the restitution recommendation.

Nachreiner’s attorney also declined to comment. Attempts to reach Haidl’s and Spann’s attorneys were unsuccessful.
