Fox Broadcasting begs to differ with Barry Diller.

On Monday, Diller suggested that Aereo -- the start-up company he is backer of that distributes broadcast content via the Internet -- had successfully beaten legal challenges from the broadcasters.

“We think the lawsuit is over,” Diller said at the Milken Institute Global Conference in Beverly Hills.

Diller was referring to the fact that earlier this month the U.S. Court of Appeals for the 2nd Circuit in New York ruled that Aereo’s transmissions and recordings of broadcast programming do not violate copyright law.

Fox, a network that Diller helped build in the late 1980s, fired back at the mogul.

“Despite Mr. Diller’s comments, the legal battle is far from over,” Fox said in a statement. “We will continue to aggressively pursue this in the courts and believe we will prevail.”
