An 18-year-old El Cajon man who raped and kidnaped a young woman after she took her infant son to Grossmont Hospital was sentenced Tuesday to eight years in custody with the California Youth Authority.

San Diego Superior Court Judge Barbara Gamer followed the recommendation of CYA officials that Jan Hlavecek be in their care rather than state prison for his term.

Hlavecek listened to the sentencing through Czechoslovakian interpreter Mark Bridle. In addition, a deportation hearing was set for July 31.

Hlavecek pleaded guilty Feb. 6 to rape and kidnaping after a jury deadlocked 5-7 for acquittal in December. The attack occurred June 24, 1984, and during the abduction the woman and her child were taken to San Clemente and back again to the hospital.

The Czechoslovakian immigrant was sent to the CYA for a mandatory diagnostic study on March 6, because the crime occurred when he was 17 years old. He was earlier ordered to be tried as an adult.

“He’ll do more time under this (CYA term) than if he was sent to prison,” said Deputy Dist. Atty. John Massucco. CYA normally releases prisoners at age 23, but it can ask for an extension, Massucco said. Hlavecek then could serve the remainder of his term in an adult prison.
