Prosecutors said Wednesday no charges will be filed against a St. Louis Cardinals’ fan accused of splashing water in the face of Dodger second baseman Steve Sax.

The fan, Andrew Wolfson, had been booked on a misdemeanor charge of third-degree assault. Wolfson, 36, was accused of splashing rainwater that had accumulated on the top of the Dodgers’ dugout at Busch Stadium during the National League playoff game Monday.

The circuit attorney’s office said it refused a warrant against Wolfson because Sax had left St. Louis without signing a complaint.

Sax was walking back to the dugout after striking out when the incident occurred. He had believed the water was beer and had said it burned his eyes.
